(Meredith) – A Florida man insisted he wasn’t drinking while driving because he only took sips of his bourbon while waiting at stop signs and traffic signals, authorities said.
That explanation, however, didn’t keep 69-year-old Earle Stevens out of jail.
A deputy arrested Stevens on June 27 after a woman called to complain about him bumping into the back of her car “over and over” at a McDonald’s drive-thru in Vero Beach, the Miami Herald reported.
When the deputy looked inside Stevens’ car, he found an open bottle of Jim Beam in the passenger seat, according to an arrest affidavit.
The deputy said Stevens had bloodshot eyes and his breath smelled of alcohol. At one point the deputy said Stevens also told him “he felt pretty good” while slurring his words.
After learning Stevens didn’t have a valid driver’s license, the deputy asked the 69-year-old if he had been drinking that day. Stevens reportedly answered “yes” but argued he only drank at stop signs, not while the vehicle was moving.
Stevens then took a field sobriety test and allegedly blew a .153 and .147 on the breathalyzer.
He was charged with DUI and driving without a valid Florida license. Deputies said he also has two prior DUIs in Missouri.
